After Session *

It is understood that proof galleries will be delivered 2-3 weeks (plus or minus a day or two depending on workload) after session completion. After viewing proofs, client agrees to select and purchase digital files. Photographer is to be paid in full for digital files before any final files will be delivered. Payment for any print products must be made before orders for such products will be placed. It is understood that selections (digital and/or product) must be made within 1 month of the date the proof gallery is sent. Once that date is passed, the gallery will become inaccessible and a fee of $75 will be charged to reinstate the gallery.

TERMS + CONDITIONS *

This is a legally binding contract between Melissa Nocks, Mel Nocks Photography, LLC, DBA Dear Lissie Photography and the client stated above. It supersedes all previous agreements (verbal or written) between parties. The only way to add or change this agreement is to do so in writing, signed by all parties. If any parties waive or alter part of this agreement, the rest of the agreement remains intact.

Studio and Location *

It is understood that newborn sessions are completed in the Dear Lissie Photography studio. All maternity sessions are scheduled as STUDIO ONLY sessions unless discussed with DLP in detail PRIOR TO SCHEDULING. If an outdoor session or outdoor portion of session is discussed, it is understood that fewer scheduling options will be available. Separate locations will require an additional fee.

Scheduling *

Clients are to notify photographer of birth within 48 hours of birth in order to ensure schedule availability within the preferred 6-21 day window for photographing newborns. If not notified within 48 hours, no guarantees can be made that the newborn session can be scheduled within the ideal window. In this case and if the newborn is scheduled beyond the ideal window, no guarantees can be made about achieving images reflective of the look and style that exists in the portfolio on the Dear Lissie Website, although every effort will be made on the behalf of the photographer. Newborns are photographed within this window of time in order to achieve the sweet, sleepy, womb-like poses and to preserve the earliest details of the baby before that fleeting time period is over. Maternity sessions are to be photographed at between 32 and 36 weeks gestation.

Respect of Time

Client understands that they will be on time for their scheduled session. If possible, the photographer will allow a grace period of up to 15 minutes as long as communication has been made. The photographer reserves the right to reduce the length of the session by the amount of minutes the client is late. If client is to arrive after the 15 minute grace period, the photographer reserves the right to cancel the session.

Cancellations *

If the session is cancelled or postponed by the client with more than 30 days prior to the session, the nonrefundable retainer payment will not be returned, it being the agreed loss suffered by the photographer due to cancellation. In the unlikely event the photographer determines that she is unable to complete the coverage due to unforeseen circumstances, all money (including the retainer fee) will be returned to the client. In the unlikely event that the photographer is too ill to complete the session or some other emergency should arise and if unable to reschedule, she will arrange for a new photographer of equal caliber and quality or will return all monies at the discretion of the client.

Limit of Liability; Release of Photographer *

While it is understood that Dear Lissie Photography implements extensive safety precautions, accidents can happen. If Client has any claim or cause of action against Photographer under this Agreement or based on the services provided, whether arising in tort or contract, or if Client (or Client’s minor child or children which participate in the photography session) is personally injured while Photographer is providing the services under this Agreement, even if based on or caused by Photographer’s negligence or the negligence of Photographer’s employees or independent contractors, Client’s recovery and Photographer’s liability is limited to the total amount paid from Client to Photographer under this Agreement and Photographer will have no further liability to Client, regardless of the total amount of costs or damages, including but not limited to direct, special, incidental, indirect, or consequential damages, claimed by Client. Client’s recovery is likewise limited to the total amount paid from Client to Photographer under this Agreement in a situation where the digital files or film negatives are lost or damaged through camera malfunction, where Photographer’s camera(s), memory cards or film negatives are stolen, or where Photographer’s equipment is otherwise lost or damaged. In the unlikely event of a total photographic failure or cancellation of this contract by either party or in any circumstance, the liability of one party to the other shall be limited to the total value of the contract. Neither party shall be liable for indirect or consequential loss. Any legal matters will be held in the photographer’s home state, any legal fees incurred by the photographer as a result of a client prosecution will be paid by the client.

Copyright, Reproduction, and Model Release *

The copyright of the photographs is retained by the photographer at all times throughout the world. Where a download link of photographs has been included for the clients as part of the session collection, these photographs will include a print release and may be printed, and or displayed online, for personal use. Commercial uses must be expressly approved in written form by the photographer and include citation. The photographer retains the right to use the photographs for the purposes of advertising or otherwise promoting her work. Client agrees not to sell any of the files or prints without written permission from the photographer. The client agrees to have themselves and others in their photographs pictured in such a way. The client agrees that they are signing a model release to allow the use of their photographs (of themselves or their child) for the photographer’s business purposes.

Social Media *

This clause applies to all social media, including but not limited to Facebook, Instagram, TikTok and blogs. When published online it is required that citation of photographer be made. The client agrees that they will under no circumstances alter the photographer’s photographs that are placed in public on the internet. As a photographer, I need photographs that are placed online to be accurate representations of my work so that future clients have a good understanding of the type of photographs that they’ll receive. The client agrees to be responsible for any family member or friend who posts my photographs online and agrees that they cannot be cropped (with the exception of the forced cropping for Facebook’s Timeline or Instagram), altered in color, or edited in any way.

Retention and Protection of Final Files *

No images or products shall be provided before payment is made in full. Once the JPEG files are delivered to the client, it is the client’s sole responsibility to protect and retain their images for the future. It is highly recommended that downloaded final files be duplicated and stored in multiple locations that are cool and dry. (Technology can be fickle; one of the best ways to ensure the client’s images will last for generations is for the client to print them.) If client requires old files to be duplicated by the photographer, and they are still within the photographer’s possession, a restocking fee may be applied.

Satisfaction + Accuracy *

While the photographer will allow creative input from the client (ie. color/style incorporation), the photographer reserves the right to uphold her style and creative integrity. If at any point the desire of a client threatens the safety of a child or the safety of herself, the photographer reserves the right to cease photographing. The client agrees that the work delivered will be of a similar style and caliber to those photographs on our website and blog, and that the photographer will have complete creative control during the session and in post-processing. The images will be delivered in JPEG format with a mix of color and black and white images (unless the client specifically requests otherwise and the photographer agrees), and deemed appropriate by the photographer. No re-editing will be done after the final edited copies are presented to the client without additional fees and agreement from both parties. The client agrees that the photographer can only capture the situation that happens; weather, location, schedule complications, time restraints and subject’s ability to cooperate, are all factors in the quality of the photographs. The photographer will not edit for physical size, hair, nor any other physical appearance issue other than blemishes, unless an additional request, approval and payment has been made.

Interference/Obstruction *

No clients, family members or guests may impede the photographer when she is shooting or performing her duties; failure to comply with this may result in missed moments or fewer delivered images. The responsibility of this will fall on the client to ensure all are in compliance. Use of cell phone photography is prohibited without consent from photographer (ie. I don't mind if you want to grab a few behind the scenes shots but if they go on social media, be sure to tag my business!) No other professional photographers will be hired by the client or located on site photographing the client unless otherwise approved by Melissa Nocks of Dear Lissie Photography.

Notification of Sickness *

I understand that it is my responsibility to notify DLP if I am sick or my child/family members are sick. Even if we are considered not contagious but still unwell (i.e. ear infection, injury) we will notify DLP. If notified of any sickness, DLP will find a time to reschedule the session so everyone can be well enough to perform for the session. I understand it is my responsibility to be cognizant of bringing sickness into the DLP studio in order to protect the health of the members of DLP.

COVID-19 RELEASE *

The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. COVID-19 is extremely contagious and is believed to spread mainly from person-to-person contact. As a result, federal, state, and local governments and federal and state health agencies recommend social distancing and have, in many locations, prohibited the congregation of groups of people. Dear Lissie Photography (DLP) has put in place preventative measures to reduce the spread of COVID-19; however, DLP cannot guarantee that you or your child(ren) will not become infected with COVID-19. Further, going to a session at the DLP Studio could increase your risk and your child(ren)’s risk of contracting COVID-19. By signing this agreement, I acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that my child(ren) and I may be exposed to or infected by COVID-19 by visiting DLP and that such exposure or infection may result in personal injury, illness, permanent disability, and death. I understand that the risk of becoming exposed to or infected by COVID-19 at DLP may result from the actions, omissions, or negligence of myself and others, including, but not limited to, Melissa Nocks (photographer), assistants, and photography clients and their families. I voluntarily agree to assume all of the foregoing COVID-19 risks and accept sole responsibility for any injury to my child(ren) or myself (including, but not limited to, personal injury, disability, and death), illness, damage, loss, claim, liability, or expense, of any kind, that I or my child(ren) may experience or incur in connection with my child(ren)’s participation in DLP sessions (“Claims”). On my behalf, and on behalf of my children, I hereby release, covenant not to sue, discharge, and hold harmless DLP, its employees, agents, and representatives, of and from the Claims, including all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating thereto. I understand and agree that this release includes any Claims based on the actions, omissions, or negligence of DLP, its employees, agents, and representatives, whether a COVID-19 infection occurs before, during, or after participation in any DLP session.
